A Seremban High Court judge says they can appoint their own contractors to clear their land.

SEREMBAN: Another judge has affirmed the right of Felda settlers to appoint their own contractors to clear their plantations for re-seeding.

The Seremban High Court yesterday gave victory to the settlers of Felda Palong 9, dismissing a suit brought against them by Evergreen Sdn Bhd, the company that got the job from the Felda management to clear the land.

Evergreen was trying to prevent the settlers from appointing contractors offering more money.

The judgment appears to be part of a trend of decisions favouring settlers since last year's Federal Court dismissal of Felda's appeal against the Kota Baru High Court's award of damages to the settlers of Kemahang 3, who had sued the authority for manipulating palm oil grading.

Subsequently, settlers in Sungai Koyan 2, Sungai Koyan 3 and Raja Alias 2 also won their cases against Felda.

The case that ended yesterday involved 30 settlers who plant rubber. Judge Zulkifli Bakar gave his decision in chambers.

PKR deputy secretary-general T Kumar, one of the lawyers for the settlers, said they could now appoint their own contractors to clear the land and take the lumber.

He said they had collectively decided on a contractor who was offering RM50,000 for each acre. Evergreen's price was RM33,000 an acre.

In dismissing Evergreen's suit, the judge ordered the company to pay RM15,000 in costs.

According to another lawyer for the settlers, P Rajasundram, Evergreen got the job as a subcontractor for LBJ Global SdnBhd, the company that the Felda management appointed.

"The judge said the plaintiff could not enforce the agreement between LBJ Global and Felda," he told FMT.

MalaysiaToday : KOTA BHARU - 131 settlers from Felda Kemahang 1 and 2 yesterday secured another court victory against the Federal Land Authority (Felda) for failing to return their investment in its replantation fund over the last 20 years.

In his verdict, Kota Bharu High Court judge Mohd Azman Husin ordered Felda to pay RM1.2 million as compensation to the settlers, and called for an audit on the body's replantation fund.

In an immediate response, National Felda Settlers' Children Association (ANAK) chairman Mazlan Aliman described the verdict as "encouraging" for the settlers and proved that ANAK's struggle had gained momentum.


"This is an encouraging result which is long awaited and is a repeat of the earlier case brought by lawyer Hanipa Maidin in the case of Felda Sungai Koyan (in which the court ruled that the settlers deserved the replantation fund).

"This shows that the struggle by Felda settlers is gaining momentum and justice is finally theirs," Mazlan toldHarakahdaily.

On the RM1.2 million compensation, Mazlan said the amount included monthly contributions as investment by the settlers and the dividend they were entitled to.

In August last year, 354 Felda settlers from Kemahang 3 in Kelantan were awarded compensation amounting to RM11 million, after Felda was found guilty of manipulating palm oil grades.

The latest victory, said Mazlan, was crucial in boosting confidence  among settlers.

"This is an important decision because it involves almost 10,000 settlers who do not receive the replantation fund, and there are cases still on trial," he said.

He revealed that some 700 settlers from Felda Jengka would be filing a suit led by lawyer Sivarasa Rasiah at the Temerloh High Court.

Meanwhile, Mazlan said the Selangor state government's Felda Task Force Secretariat had held discussion yesterday regarding the Group Settlements Act (GSA) 1960 officiated by Menteri Besar Khalid Ibrahim.

"The panel comprising of lawyers who explained and debated on the GSA from the point of weaknesses, abuses and what can be done to improve on Felda, which included how this act fairly to the settlers," he explained.

The panel, said Mazlan, agreed to identify weaknesses in the GSA and make revisions to ensure justice to land owners.
